Agreement to Terms

These Terms of Service ("Terms") govern your use of the Blue Ridge Computer website and services. By accessing our website or engaging our services, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you may not access our website or use our services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

Services Description

Blue Ridge Computer provides information technology services including, but not limited to:

  • Managed IT services for businesses
  • Co-managed IT support
  • Network design and security
  • Cloud solutions and migration
  • Backup and disaster recovery
  • IT consulting
  • Computer repair services for residential customers
  • Proactive maintenance programs
  • Network support for home users
  • Custom PC building

Specific services, terms, and pricing will be outlined in individual service agreements or quotes provided to clients.

Service Agreements

For ongoing services such as managed IT or proactive maintenance programs, a separate service agreement will be provided that outlines:

  • Scope of services included
  • Pricing and payment terms
  • Service level expectations
  • Duration and renewal terms
  • Termination procedures

In the event of any conflict between these Terms and a specific service agreement, the service agreement shall prevail.

Payment Terms

Payment terms vary based on the type of service:

  • One-time Services: Payment is due upon completion of service unless otherwise agreed in writing
  • Managed Services: Monthly fees are billed in advance according to the service agreement
  • Project Work: Payment schedules will be outlined in the project proposal or quote
  • Custom PC Builds: A deposit may be required before ordering components

We accept various forms of payment including credit cards, checks, and ACH transfers. Late payments may be subject to service suspension and/or late fees as outlined in your service agreement.

Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information necessary for service delivery
  • Maintain reasonable security practices for passwords and access credentials
  • Promptly notify us of any security incidents or concerns
  • Provide reasonable access to systems and equipment as needed for service delivery
  • Ensure proper licensing for software used in your environment
  • Back up critical data before any repair or maintenance work (we recommend backups but are not responsible for data loss)
  • Pay invoices according to agreed-upon terms

Limitation of Liability

To the maximum extent permitted by law:

  • Blue Ridge Computer shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claim arising from our services shall not exceed the amount paid for those specific services
  • We are not responsible for data loss; clients are encouraged to maintain their own backups
  • We are not liable for damages caused by third-party products, services, or software
  • We are not responsible for delays or failures caused by circumstances beyond our reasonable control

While we exercise reasonable care in providing our services, no IT service can guarantee 100% uptime or complete protection against all threats.

Confidentiality

We understand that providing IT services requires access to sensitive business and personal information. We commit to:

  • Treating all client information as confidential
  • Using client information only for the purpose of delivering services
  • Not disclosing client information to third parties except as necessary to provide services or as required by law
  • Implementing reasonable security measures to protect client data

Upon termination of services, we will return or securely dispose of client data according to the client's instructions.

Intellectual Property

The content on our website, including text, graphics, logos, and images, is the property of Blue Ridge Computer and is protected by copyright and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our website content without our prior written consent. Any tools, scripts, or documentation we create specifically for a client remain the property of Blue Ridge Computer unless otherwise agreed in writing.

Website Use

When using our website, you agree not to:

  • Use the website for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the website or our systems

Hardware: Hardware sold or installed by Blue Ridge Computer is covered by the manufacturer's warranty. We will assist with warranty claims but are not responsible for manufacturer warranty terms.

Website: Our website is provided "as is" without warranties of any kind. We do not guarantee that the website will be error-free, secure, or continuously available.

Third-Party Products: We make no warranties regarding third-party software, hardware, or services recommended or implemented as part of our services.

Termination

Either party may terminate ongoing services according to the terms outlined in the applicable service agreement. In the absence of a specific agreement:

  • Either party may terminate services with 30 days written notice
  • We reserve the right to immediately terminate services for non-payment or violation of these Terms
  • Upon termination, client will be responsible for payment for all services rendered

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved in the courts located in Roanoke, Virginia.

Indemnification

You agree to indemnify and hold harmless Blue Ridge Computer, its owner, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your violation of these Terms, your use of our services, or your violation of any rights of a third party.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
